Terms and Conditions

1. Parties
- a. Client: the natural person or legal entity that enters into an agreement with Umrah Booking
- b. Fee: the amount that the Client owes to Umrah Booking for the services provided
2. Definitions
- a. Umrah Booking hereby expressly declares that these general terms and conditions apply to all offers and agreements with Umrah Booking
- b. Deviations from these general terms and conditions are only valid if expressly agreed upon in writing
- c. The applicability of any general terms and conditions used by the Client is hereby expressly rejected
- d. These general terms and conditions also apply to agreements with Umrah Booking where third parties need to be involved for execution
- e. If one or more provisions of these general terms and conditions are void or voidable, the remaining provisions shall remain in full force
3. Applicability
- a. Every offer from Umrah Booking is without obligation
- b. All prices quoted by Umrah Booking are in euros and include VAT, unless stated otherwise
- c. Statements and specifications in offers are given with the greatest possible accuracy. Umrah Booking is not bound by obvious errors or mistakes in the offer
- d. Obvious mistakes or errors in the offer are not binding on Umrah Booking
- e. An agreement is concluded after written acceptance by the Client of the offer made by Umrah Booking
- f. Umrah Booking is not a party to the agreement between the Client and the travel service provider
- g. The offer is made after good consultation between Umrah Booking and the Client
- h. A composite quotation does not oblige Umrah Booking to perform part of the assignment for a corresponding part of the stated price
4. Offer and Agreement
- a. Umrah Booking represents and warrants that it will perform its services with due care
- b. Umrah Booking will fulfill its obligations under this agreement to the best of its ability
- c. Umrah Booking is free to engage third parties for the execution of the agreement
- d. Umrah Booking is completely free in the selection of these third parties
- e. Umrah Booking will fulfill the agreement to the best of its knowledge and ability
- f. Umrah Booking will adjust the execution of the agreement if necessary
- g. Any additional costs will be charged to the Client
- h. Umrah Booking reserves the right to cancel the agreement in case of force majeure
5. Execution Agreement Umrah Booking
- a. The Client gives Umrah Booking the opportunity to execute the agreement
- b. Providing all necessary cooperation
- c. Ensure timely access to all necessary information
- d. Ensure timely execution of all preparatory work
- e. Additional costs due to delay will be charged to the Client
- f. Damage resulting from incorrect or incomplete information will be charged to the Client
- g. The Client must ensure they have all necessary documents
- h. The Client is responsible for obtaining appropriate travel insurance
- i. The Client must obtain information from competent authorities
- j. The Client must verify exact departure times
- k. The Client must comply with airlines' restrictions
- l. Travel in orange/red areas is at Client's own risk
- m. The Client must be of legal age to enter into this agreement
- n. The Client must keep login details confidential
- o. Copying content from the website is prohibited
- p. The Client confirms they are of legal age to enter into this agreement
6. Execution Agreement Client
- According to Article 7:408 of the Dutch Civil Code
- Umrah Booking has the right to terminate the agreement if:
- a. The Client ceases their business activities
- b. The Client is granted suspension of payments
- c. The Client has provided misleading information
7. Interim Termination Agreement
- The Client guarantees the accuracy and completeness of the information provided.
- a. Umrah Booking is liable only for direct damages resulting from its services.
- b. Umrah Booking is not liable for consequential damages, including lost profits.
- c. Umrah Booking is not liable for damage to property unless caused by intent or gross negligence.
- d. Any liability of Umrah Booking is limited to the duration specified in the agreement.
- e. Liability for defects exists only if reported within a reasonable period after discovery.
8. Liability
- a. All data will be processed in accordance with applicable privacy laws
- b. All intellectual property rights remain with Umrah Booking
- c. Both parties will maintain confidentiality of sensitive information
- d. Prohibition to approach employees or contractors
- e. Violation of these terms may result in fines
9. Privacy, Intellectual Property Rights, Confidentiality & Anti-Solicitation Clause
- a. Umrah Booking is not required to fulfill any obligation if prevented from doing so as a result of force majeure
- b. Force majeure includes, in addition to what is understood in law and jurisprudence, all external causes, foreseen or unforeseen, over which Umrah Booking cannot exercise influence
- c. Umrah Booking can suspend the obligations from the agreement during the period that the force majeure continues
10. Force Majeure
- a. These terms may be updated for continuing performance agreements
11. Changes to General Terms and Conditions
- a. Umrah Booking may transfer its rights to third parties
- b. The Client may not transfer rights without written consent
- c. Dutch law applies, with express exception of the Vienna Sales Convention
